Notice of Intent (NOI)

In order to be covered by the Arizona NPDES General Permit for CAFOs, a Notice of Intent (NOI) must be submitted to EPA and, for those operations not on tribal land, ADEQ.

A NOI is not an application for coverage. It is a notice of intent to be covered by the permit. It is a first step in the permit process.

An existing operator can still submit a NOI.

A new CAFO (after August 27, 2001) must submit a NOI 90 days prior to the time the operation becomes a CAFO. In addition to the NOI, an operator must also submit an Environmental Impact Document (EID).

An operation that is designated by ADEQ or EPA as a CAFO must submit the NOI within 90 days after designation.

To determine the latitude and longitude of the facility, the topozone website (topozone.com) will be useful. You will also need to determine the 25 year - 24 hour storm event for your location.
